About CeleBits
CeleBits, is a web application that allows you to submit an article that will be reviewed by
all and will be promoted, based on popularity, to the main page. When a user submits a news
article it will be placed in the "unpublished" area until it gains sufficient votes to be
promoted to the main page. The idea of CeleBits was influenced by the extremely popular English technology site
digg.com but with a "Celebrity News and Gossip" spin.

REVENUE SHARING

Description of Service. CeleBits is a free, online application. You understand and agree that the Service is provided on an AS IS and AS
AVAILABLE basis. CeleBits disclaims all responsibility and liability for the availability,
timeliness, security or reliability of the Service. CeleBits also reserves the right to
modify, suspend or discontinue the Service with or without notice at any time and without
any liability to you.

Personal Use. The Service is made available to you for your personal use
only. Due to the Children's Online Privacy Protection Act of 1998 (which is available at
http://www.ftc.gov/ogc/coppa1.htm), you
must be at least thirteen (13) years of age to use this Service. You must provide current,
accurate identification, contact, and other information that may be required as part of the
registration process and/or continued use of the Service. You are responsible for
maintaining the confidentiality of your Service password and account, and are responsible
for all activities that occur thereunder. CeleBits reserves the right to refuse service to
anyone at any time without notice for any reason.

Proper Use. You agree that you are responsible for your own communications
and for any consequences thereof. Your use of the Service is subject to your acceptance of
and compliance with the Agreement. You agree that you will use the Service in compliance
with all applicable local, state, national, and international laws, rules and regulations,
including any laws regarding the transmission of technical data exported from your country
of residence. You shall not, shall not agree to, and shall not authorize or encourage any
third party to: (i) use the Service to upload, transmit or otherwise distribute any content
that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or
is otherwise objectionable as reasonably determined by CeleBits; (ii) upload, transmit or
otherwise distribute content that infringes upon another party's intellectual property
rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent
others from using the Service; (iv) use the Service for any fraudulent or inappropriate
purpose; or (v) act in any way that violates the Program Policies, as may be revised from
time to time. Violation of any of the foregoing may result in immediate termination of this
Agreement, and may subject you to state and federal penalties and other legal consequences.
CeleBits reserves the right, but shall have no obligation, to investigate your use of the
Service in order to determine whether a violation of the Agreement has occurred or to
comply with any applicable law, regulation, legal process or governmental request.

Your Intellectual Property Rights CeleBits does not claim any ownership in
any of the content, including any text, data, information, images, photographs, music,
sound, video, or other material, that you upload, transmit or store in your CeleBits account.
We will not use any of your content for any purpose except to provide you with the
Service.

Representations and Warranties. You represent and warrant that (a) all of
the information provided by you to CeleBits to participate in the Services is correct and
current; and (b) you have all necessary right, power and authority to enter into this
Agreement and to perform the acts required of you hereunder.

Privacy. As a condition to using the Service, you agree to the terms of
the CeleBits Privacy Policy as it may be updated from time to time. CeleBits understands that
privacy is important to you. You do, however, agree that CeleBits may monitor, edit or
disclose your personal information, including the content of your emails, if required to do
so in order to comply with any valid legal process or governmental request (such as a
search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms
of Use and the CeleBits Privacy Policy. Personal information collected by CeleBits may be stored
and processed in the United States or any other country in which CeleBits or its agents maintain facilities. By using CeleBits, you consent to any such transfer of
information outside of your country.

Indemnification. You agree to hold harmless and indemnify CeleBits, and its
subsidiaries, affiliates, officers, agents, and employees from and against any third party
claim arising from or in any way related to your use of the Service, including any
liability or expense arising from all claims, losses, damages (actual and consequential),
suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a
case, CeleBits will provide you with written notice of such claim, suit or action.
CeleBits.com is designed with revenue sharing in mind. Celebits understands that users contribution helps expand CeleBits reach and usefulness and such, intends to share a percentage of advertising revenue with users who contribute substantially. The revenue sharing portion is instended for users who submit a large amount of stories on a continued basis and is limited by various restrictions. The percentage of revenue earned is based on the activity of said users as explained below.
CeleBits.com revenue sharing is done with Google AdSense ad network. All other ads, including banners, text links and other contextual advertisments are exempt from the revenue sharing system. Users who wish to take part in the revenue sharing must have their own Google AdSense account. Once a user inputs their AdSense account ID into their CeleBits.com user profile, and their revenue sharing is activated by CeleBits.com staff, any new stories that are submitted through their account are elegible for revenue sharing. Revenue sharing module is automated once a user is activated by the CeleBits staff and has enterered their own Google AdSense Publisher ID into their CeleBits Profile. On stories they submit, their Google AdSense ads will be displayed a set percentage of the impressions dictated by users activity level.
Revenue sharing is reserved for active contributors of CeleBits.com. Users must qualify, though example, to be included in the revenue sharing program. After a user submits 50 qualified stories they are eligible for revenue sharing and will need to contact support to have their account upgraded. The starting revenue share percentage for users who qualify is 25%. This means an average of 25% of impressions to their story pages will display their own ad code and any revenue earned through their AdSense modules will be the users. Only story pages that the specific users submits will be rotated with their ad code.
A "qualified" story is defined as:
- a unique story...not just a repost of something already featured or queued on CeleBits.com
- an interesting story dictated by gaining at least 10 "votes" from other users. Use of multiple accounts or having a bunch of "friends" vote for your story just to make it qualify is not allowed and may be terms from expulsion of your account from the revenue sharing program. We will be watching ;) for sketchy stuff (IE proxies and other questionable things)
Higher percentage revenue share is available for users with higher contribution levels, up to 50%, depending on level of activity and contribution. Special consideration may also be made for partners of CeleBits.com and other various special promotions.
CeleBits.com revenue sharing is wholely dependant on the Google AdSense ad service and, as such, is limited to the availabilty and fuctionality of the Adsense program. CeleBits.com can not be responsible downtime or errors related to the availability of Google AdSense.
Although Celebits.com publishes users AdSense IDs with the revenue sharing system, it is completely up to the user to make sure they read, understand and follow all of the AdSense terms of service. CeleBits.com can not be responsible for users who have their accounts banned or limited due to not following the terms of AdSense.
CeleBits.com is in no way responsible for making payments to any users through the revenue share program. All earnings, tracking and payments are handled and controlled by Google through the AdSense program. It is the users responsibility to know and understand their AdSense account. Users shall not hold CeleBits.com liable for any earnings as CeleBits only displays your ad code and is not directly paying you.
Although CeleBits intends to keep the revnue sharing service functional, the revenue sharing system is experimental and may not be a pernament part of our site. We may discontinue the program at anytime, with notification of such changes updated on this page. If the revenue sharing system does not work as expected and is terminated, at our discretion, all past user submitted pages may be reverted back to CeleBits sole advertising account.
CeleBits.com also hold the right to edit and add to these terms at any point needed. Users agree to stay updated by reading this page and agree to follow any additons and/or changes.
In short, we'd like to share the money we make from AdSense ads with those that help make this site great by contributing. Unfortunately we don't know how well this will work out and may not be able to continue it but it comes down to how well it works, how helpful the users are and how much of a headache it becomes. If we can all make money with our great content then all the better for everyone. So the more help and understanding we can get from users, the better chance it will contintue and advance. Be helpful, contribute and take pride in your submissions and make money with us.
